General Terms and Conditions (GTC)
These General Terms and Conditions (GTC) govern all sales made on the online shop operated by Kaur's e-Commerze & Co. Any order placed on our site implies full and unreserved acceptance of these GTC in their version in force at the time of the order.
1. Scope of Application
These General Terms and Conditions apply to all orders placed via our online shop by consumers and, where applicable, by professionals.
A consumer is any natural person acting for purposes which are outside their trade, business, craft or profession.
A professional is any natural or legal person acting in the course of their trade, business, craft or profession.
These GTC supplement our Privacy Policy, our Shipping and Delivery Policy, our Refund Policy, and our Withdrawal Policy, all accessible from our website.

3. Products
The products offered for sale are those presented on our online shop at the time of the order, within the limits of available stock.
We strive to present the products with the greatest possible accuracy. However, photographs, illustrations, colours and descriptions are provided for informational purposes only and do not constitute a contractual commitment.
4. Prices
All prices displayed on our shop are indicated in euros (€) and include VAT where applicable.
Any delivery costs are indicated separately before the final validation of the order.
We reserve the right to modify our prices at any time. However, the applicable price is the one displayed at the time of order validation.
5. Conclusion of the Contract
The presentation of products on our online shop does not constitute a legally binding offer, but an invitation to place an order.
The sales contract is concluded when we accept your order and send you an order confirmation by e-mail.
6. Payment
We accept the payment methods offered at the time of ordering on our online shop.
Payment is due immediately upon validation of the order. All transactions are processed via secure payment providers.
7. Delivery
Shipping methods, estimated delivery times, and information regarding order tracking are described in our Shipping and Delivery Policy.
8. Right of Withdrawal
Consumers benefit from the legal right of withdrawal in accordance with applicable regulations. The terms for exercising this right are set out in our Withdrawal Policy.
9. Legal Guarantees
In accordance with Article L. 111-1 of the French Consumer Code, every consumer benefits from the following legal guarantees, regardless of any commercial guarantee that may be offered:
Legal guarantee of conformity (Articles L. 217-3 to L. 217-20 of the Consumer Code)
The consumer has a period of two years from the delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date of its appearance.
The legal guarantee of conformity applies independently of any commercial guarantee granted. The consumer may decide to implement the guarantee against hidden defects of the sold item within the meaning of Article 1641 of the Civil Code; in this case, they can choose between the cancellation of the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code.
Legal guarantee against hidden defects (Articles 1641 to 1649 of the Civil Code)
The consumer also benefits from the legal guarantee against hidden defects in application of Articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or a full refund against return of the goods.

10. Order Cancellation by the Customer
Before shipment
As long as your order is not yet being processed, prepared, or shipped, you can cancel it free of charge. Please contact our customer service immediately for this purpose.
After shipment
Once your order has been shipped, the shipment itself can no longer be cancelled. You can return the goods after receipt under your legal right of withdrawal (see our Withdrawal Policy) or under the legal guarantees mentioned in Article 9; return costs remain the responsibility of the customer under the conditions provided by our Withdrawal Policy.
If you nevertheless wish to cancel an already shipped order before receipt, actual and non-recoverable costs may have already been incurred by us (e.g., non-refundable payment provider fees, as well as shipping and logistics costs). To the extent permitted by law, we may deduct these actually incurred and justified costs from your refund. However, you retain the possibility to demonstrate that no costs, or a lesser amount, were incurred; in this case, only the actually justified amount will be deducted.
Processing your request
For any cancellation or return request, you can contact our customer service at any time via our ticket system. We will process your request as soon as possible and keep you informed of its progress. Any refund will be made, where applicable, after deducting the actually incurred and justified costs mentioned above. Your legal rights under the right of withdrawal and legal guarantees remain fully applicable in all cases.
11. Undeliverable, Refused, or Uncollected Shipments
If an order cannot be delivered to you due to an incorrect or incomplete address provided by you, a refusal of receipt, or a failure to collect, this situation is not our responsibility. You are solely responsible for the accuracy of the delivery and contact information provided during the order.
In such a case, the actual, justified, and non-recoverable costs we have incurred (shipping and return costs, processing fees, customs duties, and import fees) may, to the extent permitted by law, be deducted from any potential refund. You retain the possibility to demonstrate that a lesser damage, or no damage, has been incurred.

13. Consumer Mediation
In accordance with Articles L. 611-1 et seq. of the Consumer Code, any consumer has the right to free recourse to a consumer mediator in the event of a dispute not resolved directly with our customer service. The contact details of the competent mediator are provided in our Legal Notice.
14. Applicable Law
These General Terms and Conditions are governed by German law, without prejudice to the mandatory consumer protection provisions applicable in the consumer's usual country of residence.
