General Terms and Conditions (GTC)

1. Scope of Application

These General Terms and Conditions (GTC) apply to all orders placed by consumers and businesses via our online shop.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities (§ 13 BGB - German Civil Code).

An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or self-employed professional activity (§ 14 BGB).

3. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an non-binding invitation to place an order.

By clicking the "Order with obligation to pay" button, you place a binding offer to purchase the goods in the shopping cart.

Confirmation of receipt of your order will be sent automatically by email and does not yet constitute acceptance of the offer.

The contract is concluded only by an express declaration of acceptance or by shipping the goods.

4. Prices and Shipping Costs

All prices are final prices, including the statutory value-added tax, if legally due.

Additional shipping costs will be shown separately during the ordering process.

5. Payment Terms

Payment is made using the payment methods offered in the shop.

The purchase price is due immediately upon conclusion of the contract.

We reserve the right to exclude individual payment methods in individual cases or to offer only certain payment methods.

6. Delivery

Delivery will be made to the delivery address specified by the customer.

Delivery times are estimates and are non-binding guidelines. Delivery delays due to force majeure, official measures, customs clearances, strikes, transport disruptions or other unforeseeable events cannot be excluded.

If tracking is available, the customer will receive corresponding tracking information after the order has been dispatched.

Delivery may be carried out by external shipping service providers.

7. Customer's Duty to Cooperate

The customer is obliged to provide complete and correct information when placing an order.

In particular, the customer is responsible for:

  • the correct delivery address,
  • a valid email address,
  • an accessible phone number, if provided,
  • acceptance of delivery,
  • monitoring of provided tracking information,
  • cooperation with necessary measures of the shipping service provider.

8. Retention of Title

The delivered goods remain our property until full payment has been received.

9. Warranty

The statutory warranty rights apply.

10. Liability

We are liable without limitation for intent and gross negligence.

In cases of slight negligence, we are only liable for the breach of essential contractual obligations. In this case, liability is limited to the foreseeable damage typical for the contract.

The limitations of liability do not apply to injury to life, body, or health, or to mandatory statutory provisions.

11. Right of Withdrawal

Consumers are entitled to the statutory right of withdrawal.

12. Cancellations and Order Changes

Cancellations or change requests can only be considered as long as the order is not yet being processed, picked, or prepared for shipment.

After processing, picking, or preparation for shipment has begun, a change or cancellation may no longer be possible. If an already shipped order is nevertheless canceled before receipt, we may incur documented, actually incurred costs that cannot be reversed (see cancellation policy, section "Cancellation by the customer"); these may, to the extent legally permissible, be offset against a refund.

13. Returns

The respective published return and refund policies apply to returns.

For the fastest possible processing, we recommend contacting our customer service before returning an item.

14. Undeliverable, Refused, or Unclaimed Shipments

If a shipment is not delivered due to an incorrect or incomplete address provided by the customer, refused acceptance, non-collection, or lack of cooperation with delivery, the shipment may be returned to the shipping service provider or logistics partner.

Depending on the shipping route and destination country, documented, actually incurred and irrecoverable costs may arise.

These may include, but are not limited to:

  • shipping costs,
  • return shipping costs,
  • handling fees,
  • customs and import duties,
  • fees from shipping or logistics service providers,
  • disposal costs, if a return is not logistically possible.

Each case will be examined individually, taking into account the legal provisions.

15. Guarantees and Voluntary Services

If voluntary guarantees are offered for individual products or promotions, the prerequisites, scope, and conditions result exclusively from the respective published guarantee conditions.

Statutory rights remain unaffected by this.

16. Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

17. Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law applies only insofar as it does not restrict mandatory statutory provisions of the state in which the consumer has their habitual residence.
